Terms & Conditions

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and American Bantam Car Corporation (“American Bantam®,” “Company,” “we,” “us,” or “our”), a corporation incorporated under the laws of the State of Delaware, regarding your use of abantam.com and all associated pages, features, and services (the “Site”).

By accessing the Site, you represent that you are at least 18 years of age and legally capable of entering into a binding agreement. Use of the Site on behalf of a company or organization means you represent that you have authority to bind that entity to these Terms.

• “Site” means abantam.com and all subpages, forms, and digital materials hosted thereon.
• “Reservation” or “Pre-Order” means a non-binding expression of purchase interest submitted through the Site’s reservation flow, subject to Section 4.
• “Content” means all text, images, graphics, video, audio, vehicle specifications, and other materials published on the Site by American Bantam®.
• “User Content” means any data, text, or information you submit to the Site, including reservation forms, contact inquiries, and newsletter sign-ups.
• “Marks” means the American Bantam® trademark, logo, trade dress, vehicle model names, and all related intellectual property.

You may use the Site for lawful purposes only. You agree not to:

• Use the Site in any way that violates applicable federal, state, or local law or regulation.
• Transmit unsolicited commercial communications, spam, or malicious code.
• Attempt to gain unauthorized access to any portion of the Site or any system connected to it.
• Harvest, scrape, or collect any personal data or Content from the Site without our express written permission.
• Reproduce, distribute, publicly display, or create derivative works from any Content without written authorization from American Bantam®.
• Use the Site to impersonate American Bantam®, its employees, or any other person or entity.
• Engage in conduct that restricts or inhibits any other user’s ability to use the Site.

We reserve the right to terminate or restrict access to the Site for any user who violates these Terms, at our sole discretion and without notice.

American Bantam® offers a reservation program that allows interested buyers to express interest in purchasing a vehicle. The following terms govern all reservations:

• No Purchase Obligation: Submitting a reservation does not constitute a purchase contract. It is a non-binding expression of interest only.
• No Payment Required: Unless otherwise stated in the reservation flow, no payment is required to place a reservation.
• Fully Refundable: Where a reservation deposit is collected, it is fully refundable upon written request to orders@abantam.com at any time prior to execution of a purchase agreement.
• Specifications & Pricing: All vehicle specifications, pricing, available configurations, and delivery timelines published on the Site are estimates and subject to change without notice. Final specifications and pricing will be confirmed at the time of purchase agreement execution.
• Production Allocation: A reservation secures a place in the production queue only. American Bantam® does not guarantee a specific delivery date or production timeline.
• Modification or Cancellation: American Bantam® reserves the right to modify, delay, or cancel any vehicle program. In such event, any reservation deposit collected will be refunded in full.

All Content on the Site — including but not limited to vehicle imagery, design drawings, text, video, the American Bantam® name and logo, and vehicle model designations — is the exclusive property of American Bantam Car Corporation or its licensors and is protected by United States and international copyright, trademark, and trade dress laws.

The American Bantam® trademark is a registered trademark of American Bantam Car Corporation. Unauthorized use of the Marks in connection with any product or service is strictly prohibited and may constitute trademark infringement.

Nothing in these Terms grants you any right, title, or interest in the Marks or Content. You may not use, copy, modify, distribute, publicly display, or create derivative works from any Content without our prior written consent.

THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AMERICAN BANTAM CAR CORPORATION DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Any warranty that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
• Any warranty regarding the accuracy, completeness, or currentness of vehicle specifications, pricing, or availability information.

Vehicle specifications, pricing, payload capacities, performance figures, and delivery timelines described on the Site are forward-looking and subject to change. They do not constitute representations or warranties of any kind.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AMERICAN BANTAM CAR CORPORATION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO:

• Your use of or inability to use the Site.
• Any reliance on vehicle specifications, pricing, or availability information displayed on the Site.
• Any unauthorized access to or alteration of your transmissions or data.
• Any cancellation, delay, or modification of a vehicle program or reservation.

In no event shall American Bantam Car Corporation’s aggregate liability to you for all claims arising from your use of the Site exceed one hundred U.S. dollars ($100.00), or the amount of any reservation deposit you have paid and not been refunded, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability; in such cases the above limitations apply to the fullest extent permitted by law.

You agree to indemnify, defend, and hold harmless American Bantam Car Corporation and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your violation of these Terms.
• Your violation of any applicable law or regulation.
• Any User Content you submit to the Site.
• Your infringement of any intellectual property or other rights of any third party.

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.

We do not sell personal information. Data collected through reservation and contact forms is used solely for reservation management, order processing, and communications directly related to American Bantam® products and programs.

The Site may contain links to third-party websites, including press coverage, supplier information, and social media platforms. These links are provided for convenience only. American Bantam Car Corporation does not endorse, control, or assume any responsibility for the content, privacy practices, or terms of any third-party site.

Your interactions with third-party sites are governed solely by those sites’ own terms and policies. We encourage you to review the terms and privacy policies of any third-party site you visit.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Site shall first be addressed through good-faith negotiation between the parties. If the dispute cannot be resolved within thirty (30) days, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings conducted in Delaware.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class action, consolidated, or representative proceeding. You waive any right to a jury trial to the extent permitted by applicable law.

American Bantam Car Corporation reserves the right to modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page. We may also notify registered users by email.

Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site.
